These Terms of Service ("Terms") govern access to and use of the CheckmyWP platform. By using our services, you accept these terms in their entirety.
These Terms aim to define the terms and conditions under which Digialia (hereinafter "the Publisher") makes available to users (hereinafter "the User" or "Users") the CheckmyWP platform (hereinafter "the Platform").
The Platform is a SaaS (Software as a Service) service intended for web agencies and WordPress professionals to manage their clients, support tickets, projects, time tracking and site monitoring.
Access to and use of the Platform implies full and complete acceptance of these Terms by the User.
By creating an account or using the Platform, the User acknowledges having read these Terms and accepts them without reservation.
The Publisher reserves the right to modify these Terms at any time. Users will be informed of any substantial modification at least 30 days before it takes effect.

The Platform offers different subscription plans:
All plans include 2 sites per client. Additional sites: €0.99/month per site.
A 20% discount is applied to annual subscriptions.
A 14-day free trial is offered to every new user. No credit card is required for the trial. At the end of the trial period, the chosen subscription will be automatically activated if a payment method has been entered.
Payments are made monthly or annually by credit card or SEPA transfer. Billing is automatic and recurring.
In case of payment default, the Publisher reserves the right to suspend account access after notifying the User.
The User can modify their subscription plan (upgrade or downgrade) at any time. Changes take effect immediately and are prorated.

The Platform, its source code, structure, design, trademarks and all elements that compose it are the exclusive property of Digialia or its licensors.
These Terms do not grant the User any property rights on the Platform, but only a personal, non-exclusive and non-transferable right of use.
The User retains full ownership of the data they enter and store on the Platform.
The Publisher undertakes to process Users' personal data in accordance with GDPR and the French Data Protection Act.

The Publisher strives to ensure Platform availability 24/7, subject to maintenance operations.
The Publisher cannot guarantee 100% availability and cannot be held responsible for service interruptions, particularly in case of:
Maintenance operations may be performed regularly. The Publisher undertakes to perform these operations primarily outside business hours and to inform Users in advance when possible.
The Platform is provided "as is". The Publisher does not guarantee that the Platform will be free from errors or bugs.

The Publisher performs automatic daily data backups. However, Users are recommended to make their own regular backups of their critical data.
The Publisher reserves the right to suspend or terminate a User's access in case of:
The User can terminate their subscription at any time from their account. Termination takes effect at the end of the current billing period. No refund will be made for the already paid period.
In case of termination, the User will lose access to the Platform and their data. A 30-day period is granted to export data before permanent deletion.
The Publisher reserves the right to modify these Terms at any time to adapt to Platform evolutions, legislation or for any other legitimate reason.
Users will be informed by email of any substantial modification at least 30 days before it takes effect.
Continued use of the Platform after the new Terms take effect constitutes acceptance thereof.
These Terms are governed by French law.
In accordance with article L.612-1 of the French Consumer Code, in case of dispute, the User has the right to use a consumer mediator free of charge for amicable dispute resolution.
Failing amicable resolution, any dispute relating to these Terms will be submitted to the competent French courts.
